If you retrieved something and did't pay for it they can can try sue you if he has some sort of evidence. Everything else depends on many factors. (How can there be no evidence, not even mails, chat logs etc?). No one can give you any advice here, we don't even know the details.
Just ask a lawyer if it's important to you. The only way to get solid advice.
